These Terms and Conditions ("Terms") govern your use of the website www.phlebotomyanywhere.com and the services provided by Phlebotomy Anywhere, LLC, Phlebotomy Anywhere ("we," "us," or "our"). By accessing our website and/or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.
1. Services Overview:
Our mobile phlebotomy services includes the collection of blood and other specimens at the patient’s chosen location and the delivery of these specimens to a designated laboratory as ordered by a healthcare provider, the DNA service requested, or SneakPeek. We do not provide medical consultations, diagnose conditions, or interpret lab results.
2. Eligibility:
- You must be at least 18 years old to use our services. If you are scheduling services for a minor or an individual under your care, you must have the legal authority to do so.
- Our services are intended for individuals residing within our service areas as listed on our website.
3. Scheduling and Payment:
- Appointment Booking: Appointments can be booked through our website, by phone, or via email. Scheduling is subject to availability.
- Payment: Full payment is required at the time of scheduling to confirm your appointment. Payment methods accepted include credit/debit cards, PayPal and other payment options listed on our website.
- Cancellation and Rescheduling: Cancellations or rescheduling must be made at least 48 hours in advance of the appointment time. Failure to do so may result in the forfeiture of the appointment fee. Please refer to our Appointment Cancellation and Rescheduling Policy for more details.
4. Refund Policy:
- Cancellations with 48+ hours' notice: The full amount will be credited toward a future appointment, valid within 14 days.
- Cancellations with less than 24 hours' notice: Payments are non-refundable and not credited.
- Rescheduling with less than 24 hours' notice: A $50.00 rescheduling fee applies.
-No-Show Policy: A no-show is defined as not being present at the appointment location within 15 minutes of the scheduled time . No-shows forfeit the full appointment fee, with no credit or refund issued. Please refer to our Appointment Cancellation and Rescheduling Policy for more details.
5. Patient Responsibilities:
- Accurate Information: You agree to provide accurate, current, and complete information when scheduling appointments and during service delivery.
- Preparation for Appointment: You are responsible for following any instructions provided by your physician or laboratory, such as fasting or medication adjustments.
- Safe Environment: You are responsible for ensuring a safe and appropriate environment for our phlebotomists to perform the blood draw. If the environment is deemed unsafe or unsuitable, the appointment may be rescheduled or canceled at our discretion. If the appointment is canceled due to unsafe conditions, credits will be handled according to our Appointment Cancellation Policy. If less than 24 hours' notice is given, the full appointment fee will be forfeited. If rescheduling is necessary due to safety concerns, a $50 rescheduling fee will apply.
Please ensure a safe environment to avoid cancellations, forfeiture of fees, or additional charges.
6. Privacy and Confidentiality:
- We are committed to protecting your privacy and safeguarding your personal and health information. Our use of your information is governed by our Patient Privacy Policy and which is available on our website.
- We collect, use, and share your information only as necessary to provide our services, comply with legal obligations, and improve our operations.
7. Lab Results and Medical Advice:
- Our phlebotomists do not provide medical advice or interpret lab results. Specimens are delivered to the laboratory as per the physician’s order, the DNA service requested, and SneakPeekand. Physician lab order results are sent directly to your physician. DNA and SneakPeak results are provided to the patient directly with the email provided by the patient at the time of booking the service.
- You are responsible for contacting your physician’s office for your lab results and any follow-up care.
8. Limitations of Liability:
- Our services are provided "as is" and without warranties of any kind, whether express or implied. We are not responsible for any adverse effects resulting from your use of our services or reliance on information provided by us.
- We are not liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our services, including but not limited to delays, errors in specimen collection or delivery, or actions taken by third-party laboratories.
9. Indemnification:
You agree to indemnify, defend, and hold harmless Phlebotomy Anywhere, LLC, Phlebotomy Anywhere its employees, contractors, and agents from any claims, damages, losses, liabilities, costs, or expenses arising out of your use of our services, violation of these Terms, or violation of any rights of a third party.
10. Intellectual Property:
All content on our website, including text, graphics, logos, and images, is the property of Phlebotomy Anywhere, LLC, Phlebotomy Anywhere or our content suppliers and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our prior written consent.
11. Website Use:
- You agree not to use our website for any unlawful or prohibited activities, including but not limited to hacking, data mining, or transmitting viruses.
- We reserve the right to suspend or terminate your access to our website if you violate these Terms or engage in conduct that we determine to be harmful to our business or other users.
12. Changes to Terms and Conditions:
We may update these Terms from time to time. Any changes will be posted on our website, and the updated Terms will be effective immediately upon posting. Your continued use of our website and services constitutes acceptance of the revised Terms.
13. Governing Law:
These Terms shall be governed by and construed in accordance with the laws of Nebraska, without regard to its conflict of law principles. Any legal action arising out of or relating to these Terms shall be filed in the courts located in Douglas County, Omaha, Nebraska.
